Roles of Licensed Certificate Authority
Responsibility related to Guarantee
KICA guarantees the following related to the issue of certificates.
- 1. Contents included in issued certificate are true
- 2. Certificate is issued in accordance with the law
- 3. Suspension and annulment of certificate validity are true
Indemnity
KICA shall be liable for damages when it makes the damages to subscribers as violating the Digital Signature Act, enforcement decree, enforcement regulations and Certificate Practice Statement (CPS) related to providing certification service.
Limitation of Indemnity
1. KICA shall be liable for the damages within limitation of indemnity when the total amount of compensation on all direct or indirect physical losses that are incurred to subscribers related to providing certification service exceeds the limitation of indemnity of KICA.
2. When the damage exceeds the limitation of indemnity, KICA shall be liable for the damages that the dispute is finalized within the limitation of indemnity if a court does not judge it.
Indemnity Exception
KICA shall not be liable for the followings.
- 1. Damages arising out of the unauthorized use or purpose by a subscriber
- 2. Damages arising out of the causes that are not responsibility of Korea Information Certificate Authority such as communication route errors or subscriber system errors
- 3. Damages of the person who has the certificate that are caused because the concerned person does not conform to the obligation
- 4. Damages except the direct and compensational damages related to certificates that KICA issues and its certification process
- 5. Damages arising out of the information that subscriber provide through illegal method
- 6. Damages arising out of the information that subscribers do not provide by their defaults or intentionally or that subscribers change intentionally
- 7. Damages arising out of the subscribers' negligence on the management of the Digital Signature creation key
- 8. Damages arising out of other reasons except the contents that are defined in the Digital Signature Act and certification service regulations
Indemnity of Subscribers
When a subscriber inflicts a loss to KICA as violating the obligations of subscribers or as using the subscribers' service, the subscriber shall compensate all loses of KICA.
Reimbursement of Payment
1. When a subscriber wants to cancel the subscription as judging that the service quality of KICA does not meet the defined standard or KICA does not provide the defined services, the subscriber can request the reimbursement of the payment and the reimbursement application shall be done within 10 days from the date when the certificate is issued.
2. KICA shall deduct the required expenses that are defined and refund the remaining amount when a subscriber requests the cancellation and reimbursement related to subscription of certificate service within the determined period.
